This subpart applies to:
- Miscellaneous organic chemical manufacturing process units (MCPUs) located at Major Sources of HAPs*.
Definition of "Miscellaneous Organic Chemical Manufacturing Process Unit (MCPU)":
- Includes equipment necessary to operate a miscellaneous organic chemical manufacturing process that satisfies all of the following conditions:
- The MCPU produces material or a family of materials that is described in any of the following:
- Any organic chemical(s) classified using the 1987 version of SIC code 282, 283, 284, 285, 286, 287, 289, or 386;
- Any organic chemical(s) classified using the 1997 version of NAICS code 325;
- Quaternary ammonium compounds and ammonium sulfate produced with caprolactam;
- Hydrazine;
- Organic solvents classified in any of the above SIC or NAICS codes that are recovered using nondedicated solvent recovery operations.
- The MCPU processes, uses, or generates any of the organic HAPs listed in Section 112(b) of the CAA, or hydrogen halide and halogen HAP;
- The MCPU is not an affected source or part of an affected source under another Part 63 NESHAP MACT, except for process vents from batch operations within a chemical manufacturing process unit (CMPU).
Definition of "Miscellanous Organic Chemical Manufacturing Process":
- All equipment which collectively function to produce as a product or isolated intermediate any of the materials described under the definition of MCPU.
- "Process" includes any, all, or a combination of reaction, recovery, separation, purification, or other activity, operation, manufacture, or treatment which are used to produce a product or isolated intermediate.
- "Process" is also defined by the following:
- Routine cleaning operations conducted as part of batch operations are considered part of the process;
- Each nondedicated solvent recovery operation is considered a single process;
- Each nondedicated formulation operation is considered a single process that is used to formluate numerous materials and/or products;
- Quality assurance/quality control laboratories are not considered part of any process; and,
- Ancillary activities are not considered a process or part of any process;
- The end of a process that produces a solid material is either up to and including the dryer or extruder, or for a polymer production process without a dryer or extruder it is up to and including the extruder, die-plate, or solid-state reactor.
Not subject to this subpart:
- Research and development faciltiies as defined by Section 112(c)(7) of the CAA;
- The manufacture of ammonium sulfate as a by-product, if the slurry entering the by-product manufacturing process contains 60 parts per million by weight (ppmw) HAP or less, or 10 ppmw benzene or less. Sources must retain information, data, and analysis to document HAP concentrations in order to claim this exemption;
- Affiliated operations located at an affected source subject to NESHAPs GG, KK, JJJJ, MMMM, or SSSS;
- Fabricating operations, compounding operations, or extrusion and drawing operations. These are not exempt if they involve processing with HAP solvent or if an intended purpose of the operation is to remove residual HAP monomer.
- Production activities described using the 1997 version of NAICS codes 325131, 325181, 325188 (except for hydrazine), 325314, 325991 (except for reformulating plastics resins from recycled plastics products), and 325992 (except for photographic chemicals);
- Tall oil recovery systems; and,
- Carbon monoxide production.
*Major Sources of HAPs emit or have the potential to emit:
- ≥ 10 tons/year of any single HAP; or
- ≥ 25 tons/year of total HAPs.
- Area Sources emit less than Major Sources.
