Polymers & Resins IV -  Subpart JJJ

Applicability: eCFR Subpart JJJ [ecfr.gov]

This subpart applies to:
  1. Affected sources at Major Sources of HAPs* that produce any of the following:
    1. Acrylonitrile butadiene styrene (ABS) latex or resin;
    2. Acrylonitrile styrene acrylate (ASA/AMSAN) resin;
    3. Expandable polystyrene resin;
    4. Methyl methacrylate acrylonitrile butadiene styrene (MABS) resin;
    5. Methyl methacrylate butadiene styrene (MBS) resin;
    6. Nitrile resin;
    7. Poly(ethylene terephthalate) (PET) resin;
    8. Polystyrene resin;
    9. Styrene acrylonitrile (SAN) resin.
Affected sources:
  1. Groups of one or more thermoplastic product process units (TPPU) and associated equipment;
  2. Waste management units;
  3. Maintenance wastewater;
  4. Heat exchange systems;
  5. Process contact cooling towers used in the manufacture of PET at new sources;
  6. Process contact cooling towers used in the manufacture of PET using continuous terephthalic acid high viscovity multiple end finisher processes at existing sources;
  7. Components required by or utilized as a method of compliance with this subpart, including control devices and recovery devices.

*Major Sources of HAPs emit or have the potential to emit:
  • ≥ 10 tons/year of any single HAP; or
  • ≥ 25 tons/year of total HAPs.
  • Area Sources emit less than Major Sources.

Not subject to this subpart:
  1. TPPUs and associated equipment at Area Sources of HAPs*;
  2. Components and equipment that do not contain organic HAP;
  3. Stormwater from segregated sewers;
  4. Water from fire-fighting and deluge systems in segregated towers;
  5. Spills;
  6. Water from safety showers;
  7. Water from testing of deluge systems;
  8. Water from testing of firefighting systems;
  9. Vessels and equipment storing and/or handling material that contains no organic HAP and/or organic HAP as impurities only;
  10. Equipment that is intended to operate in organic HAP service for less than 300 hours during the calendar year.
  11. Research and development faciltiies;
  12. Polymerization processes occurring in a mold;
  13. Processes which manufacture binder systems containing a thermoplastic product for paints, coatings, or adhesives;
  14. Finishing processes including equipment such as compounding units, spinning units, drawing units, extruding units, and other finishing steps;
  15. Solid state polymerization processes.
Partial Exemptions:
  1. Owners or operators of TPPUs at Major Sources of HAPs* that do not use or manufacture and organic HAP need only keep records and demonstrate that they do not use or manufacture any organic HAP; they are not subject to any other provisions of this subpart.
