| Applicability: |
eCFR Subpart D  [ecfr.gov]
This subpart applies to:
- Any of the following that commence construction or modification after Aug 17, 1971:
- Fossil fuel-fired steam generating units > 73 MW (250 MMBtu/hr) heat input rate;
- Fossil fuel- and wood residue-fired steam generating units capable of firing fossil fuel at a heat input rate > 73 MW (250 MMBtu/hr).
Lignite-fired steam generating units that commenced construction or modification after December 22, 1976 are subject to some requirements (see 40 CFR 60.40(d)).
Not subject to this subpart:
- Any facility that commenced construction or modification on or before Aug 17, 1971
- Any facility subject to either NSPS Da or KKKK.
