PUBLIC NOTICE

Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue a construction permit to Whelan Energy Center (FID 58048) a coal-fired power plant (Standard Industrial Classification Code 4911- Electric Services) located at 4520 East South Street, Hastings, Adams County, Nebraska, for the installation of an auxiliary boiler. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed construction of this facility will be: 0.35 tpy of Particulate Matter (PM); 0.35 tpy of PM ≤ 10 microns (PM10) and 0.35 tpy PM ≤ 2.5 microns (PM2.5). 0.75 tpy Oxides of Sulfur; 2.11 tpy Oxides of Nitrogen; 1.20 tpy Carbon Monoxide; 0.08 tpy Volatile Organic Compounds; and 0.03 tpy total Hazardous Air Pollutants (HAP).

Adams County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species.

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which includes construction of an auxiliary boiler to assist in startup of Whelan Energy Center Unit 2 with an annual hour limitation and associated operational, monitoring, recordkeeping, and reporting requirements.

The proposed permit and supporting materials are available Tuesday, January 10, 2023 through Thursday, February 9, 2023 at the NDEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Only comments received by the Department during this period on new and significantly revised conditions to the previous construction permit(s) will be considered. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
