Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, as amended September 28, 2022, that the Department is proposing to issue a construction permit to Aurora West, LLC (FID 87072) for as-built changes and emission limit changes at an existing ethanol production facility (Standard Industrial Classification code 2869 – Industrial Organic Chemicals) located at 2103 Harvest Drive, Aurora, Hamilton County, Nebraska. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed construction of this facility will be: 2.73 tpy of Particulate Matter (PM); 0.59 tpy of PM ≤ 10 microns (PM10); 1.52 tpy PM ≤ 2.5 microns (PM2.5); 0.01 tpy Sulfur Dioxide; 0.70 tpy Oxides of Nitrogen; 0.59 tpy Carbon Monoxide; 16.73 tpy Volatile Organic Compounds; -0.29 tpy of Acetaldehyde; -5.67 tpy total Hazardous Air Pollutants (HAP).

Hamilton County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species.

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which permits the as-built changes and emission limit changes as well as the construction of a new Selective Milling Technology (SMT) system, a third liquefaction tank, and a degasser; requiring the use of control equipment to keep facility emissions below Major NSR thresholds.

The proposed permit and supporting materials are available Tuesday, January 31, 2023 through Thursday, March 2, 2023 at the NDEE, 245 Fallbrook Blvd., Suite 100, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Comments received by the Department during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
