Proposed Class I Operating Permit and Modification of Construction Permit
Notice is given to the public, according to Chapter 14 of Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air quality construction permit and a Class I air quality operating permit to Chief Industries, Inc. (FID#58049) for an ethanol manufacturing plant producing approximately 80 million gallons of denatured ethanol annually (Standard Industrial Classification code 2869) located at 4225 East South Street, Hastings, Adams County, Nebraska. The potential emissions of regulated air pollutants (in tons per year (tpy)) at this facility will be: 124.85 tpy of Particulate Matter (PM), 74.75 tpy of PM ≤ 10 microns (PM10), 35.12 tpy PM ≤ 2.5 microns (PM2.5), 310.00 tpy Sulfur Dioxide, 276.00 tpy Oxides of Nitrogen, 197.50 tpy Carbon Monoxide, 100.73 tpy Volatile Organic Compounds, 9.53 tpy of Acetaldehyde (largest quantity individual Hazardous Air Pollutant (HAP), 16.16 tpy total HAPs, and 475,152 tpy Greenhouse Gases CO2 equivalents (CO2e). The Department is also proposing to modify the facility’s existing air quality construction permit in conjunction with the operating permit to incorporate similar requirements at the same time.
Adams County meets the National Ambient Air Quality Standards (NAAQS) for NAAQS subject pollutants and is expected to continue in that status. Adams County is unclassifiable in regard to the state Total Reduced Sulfur (TRS) standards and no TRS emissions are expected from this project. No impact is anticipated on habitat for any rare or threatened species.
The NDEE proposes to issue a Class I operating permit and has reopened construction permit CP18-022 for cause in accordance with Title 129, Chapter 15, Section 006 with specific conditions, based on Title 129, which establish or revise emission limitations, performance testing and monitoring requirements. The permits also authorize requirements for control equipment (baghouses, scrubbers, and flare) for various process equipment; specifies emission limits for various equipment; specify requirements from federal NSPS rules (40 CFR 60) for Subparts A, Db, Kb, VV, and JJJJ; specify requirements from federal NESHAP rules (40 CFR 63) for Subparts A, ZZZZ, and CCCCCC; specify testing requirements for various equipment; specify inspection, operation, maintenance, and monitoring requirements; and specify related recordkeeping and reporting requirements.
The proposed permits and supporting materials are available for inspection by the public June 10, 2020 through July 13, 2020 at the office of the NDEE, Suite 400, 1200 "N" Street, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Comments received during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing, the request must state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.

Within 60 days after the US Environmental Protection Agency Administrator review, persons may petition the Administrator to object to the issuance of the proposed Class I operating permit. Any such petition shall be based only on objections to the operating permit that were raised with reasonable specificity during the 30-day comment period, unless the petitioner demonstrates that it was not practicable to raise such objection within such period.
