NOTICE OF INTENT TO APPROVE AN APPLICATION


FOR MAJOR MODIFICATION

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following animal feeding operation.

This Public Comment period will be from June 6, 2018 through July 9, 2018. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2438).

The existing and proposed livestock waste control facilities (LWCF) are located in the NW 1/4, Section 13, Township 20N, Range 04W, Platte County, Nebraska. The existing facility permit allows for a maximum 1,400 head of Swine (≥ 55 pounds) and 600 head of Weaned Pigs (<55 pounds). The current application would allow for a maximum of 2,100 head of Swine (≥ 55 pounds), or 1,900 head of Swine (≥ 55 pounds) and 600 head of Weaned Pigs (<55 pounds).

The current permit describes 1 earthen storage pit, 2 buildings with underfloor shallow pits with pull plugs, and 1 building with a gutter flush. The current application proposes the following: the closure of 1 building with a gutter flush and construction of 1 building with an underfloor deep pit, and the conversion of a building with underfloor shallow pit to hold swine instead of weaned pigs.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130–Livestock Waste Control Regulations. Currently, the Department intends to issue a Construction and Operating Permit for the proposed LWCF. Upon completing a review of any written comments received, the Department will make a final decision on the permit application and respond to any comments.
