NOTICE OF INTENT TO APPROVE AN
APPLICATION FOR MAJOR MODIFICATION

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following concentrated animal feeding operation.

This public comment period will be from September 12, 2018 through October 10, 2018. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2435).

The operation’s livestock waste control facilities (LWCFs) are located in the NE 1/4, NW 1/4, Section 35, Township 18N, Range 04W, Nance County, Nebraska. The existing LWCFs include three earthen lagoons and one underfloor shallow pit building with pull plugs. The application proposes to construct a new underfloor shallow pit building and remove a common berm between the two southernmost lagoons, creating a single larger storage facility. This work will result in a final configuration of two earthen storage pits and two underfloor shallow pit buildings with pull plugs.

The application indicates an existing maximum of 2,499 head of swine greater than or equal to fifty-five pounds, and proposes a new one-time maximum capacity of either 13,600 head of swine less than fifty-five pounds or 5,000 head of swine greater than or equal to fifty-five pounds.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130 – Livestock Waste Control Regulations. Currently, the Department intends to approve the application for a major modification to the previously issued Construction and Operating Permit. Upon completion of review of any written comments received, the Department will make a final decision on the permit application and respond to any comments.
