Notice is given to the public, according to Chapter 14 of Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue a Class II operating permit to Nebraska City Utilities – Power Plant #1 (FID# 037388) for the operation of one (1) diesel and six (6) dual fuel reciprocating internal combustion engines (RICE) at an existing power plant (Standard Industrial Classification code 4911) located at N. 1st Street and 6th Avenue, Nebraska City, Otoe County, Nebraska. The potential emissions of regulated air pollutants (in tons per year (tpy)) at this facility will be: 1.90 tpy of Particulate Matter (PM), 1.75 tpy of PM ≤ 10 microns (PM10), 1.70 tpy PM ≤ 2.5 microns (PM2.5), 0.25 tpy Sulfur Dioxide, 98.00 tpy Oxides of Nitrogen, 35.53 tpy Carbon Monoxide, 6.13 tpy Volatile Organic Compounds, 0.08 tpy of methanol (largest quantity individual Hazardous Air Pollutant (HAP), 0.24 tpy total HAPs, and 52.62 tpy Greenhouse Gases CO2 equivalents (CO2e).

Otoe County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. Otoe County is unclassifiable in regard to the state Total Reduced Sulfur (TRS) standards and no significant impact on these standards is expected from this project. No impact is anticipated on habitat for any rare or threatened species.

The NDEE proposes to issue a Class II operating permit with specific conditions, based on Title 129, which authorizes the use of diesel and dual fuel RICE to produce a maximum of 6,465,901 kWh annually. The RICE will be subject to federal rules 40 CFR 63 Subparts A – General Provisions and Subpart ZZZZ – National Emissions Standards for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines.

The proposed permit and supporting materials are available for inspection by the public September 20, 2019 through October 23, 2019 at the office of the NDEE, Suite 400, 1200 "N" Street, Lincoln, Nebraska, and electronically at http://deq.ne.gov. Comments received during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing, the request must state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.

Within 60 days after the US Environmental Protection Agency Administrator review, persons may petition the Administrator to object to the issuance of the proposed permit. Any such petition shall be based only on objections to the permit that were raised with reasonable specificity during the 30-day comment period, unless the petitioner demonstrates that it was not practicable to raise such objection within such period.
