Pursuant to the Neb. Rev. Stat. 54-2411 (4) as amended, the Nebraska Department of Environmental Quality (NDEQ) is issuing notice to provide an opportunity for any interested person to submit written comments on the “Application for Permit to Construct and Operate a Livestock Waste Control Facility” (application) which are within the authority of the Department under the Livestock Waste Management Act, Neb. Rev. Stat. Section 54-2401 through 54-2414, for the following livestock operation.

The proposed livestock waste control facility is located in Seward County, Nebraska, East Half, Section 26, Township 10 North, Range 3 East. The application as submitted is for no more than 15,500 head of feeder cattle or 15,500 Animal Units. This is a Class III livestock waste control facility (LWCF). The proposed LWCF construction includes one new debris basin, one new lift station, and one new holding pond, and closure of an existing structure as described in the application.

The Department received the last amendment to the application on March 17, 2004, and notified the Upper Big Blue NRD and Seward County Board of receipt of the application. The Department has determined the application to be complete. The Department will review the application to ensure compliance with the Livestock Waste Management Act and Title 130 - Rules and Regulations Pertaining to Livestock Waste Control. Upon completion of its review, NDEQ will issue or deny a construction permit. If issued, then a review and issuance of the operating permit is required prior to use of the LWCF.
