Notice is given to the public, according to Chapter 14 of Title 129 - Nebraska Air Quality Regulations, of the application of S.W. Energy, LLC for permission to modify the existing construction permit for an ethanol production facility, SIC code 2869, located at 71637 Road 380, McCook, Red Willow County, Nebraska, to increase production of denatured ethanol from 27.5 to a maximum of 63 million gallons per year of denatured ethanol, with associated increase in production of dried distillers grain with solubles (DDGS) and wet distillers grain with solubles (WDGS).
The potential and permitted emissions of air contaminants anticipated due to the construction of the modified ethanol plant are estimated in the following table:

Red Willow County is in attainment with the National Ambient Air Quality Standards (NAAQS) for all regulated pollutants and is expected to continue to be in attainment. Red Willow County is in compliance with the state Total Reduced Sulfur (TRS) standards and no TRS emissions are expected from this project. No impact is anticipated on habitat for any rare or threatened species.
The Department proposes to issue a construction permit with specific conditions, based on Title 129 - Nebraska Air Quality Regulations, which:
· limit type of fuel combusted in the boilers, DGS dryer and regenerative thermal oxidizer (RTO);
· require the source to comply with New Source Performance Standards (NSPS) in 40 CFR 60, Subparts Dc, Kb, and VV;
· limit PM, PM10, NOx, CO, VOC, and/or HAP emissions from major emission units;
· require the use of particulate and VOC control devices;
· require the use of Best Available Control Technology (BACT) for HAP control;
· require all truck haul roads to be paved;
· require control of fugitive dust emissions from truck haul roads;
· limit drift loss and total dissolved solids (TDS) content of cooling water;
· specify minimum stack height requirements;
· require public access restriction;
· require the source to conduct performance testing; and
· require the source to keep records documenting compliance with the permit conditions.

Within 30 days after the initial publication of this notice, persons may request or petition the Director for public hearing, or submit comments relative to the issuance of the proposed permit. Comments received during the 30 day public notice period, ending April 9, 2005, will be considered prior to the final decision to issue or to deny the proposed permit. A request or petition for hearing must state the nature of the issues to be raised and all arguments and factual grounds supporting such position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to its occurrence. Comments and requests should be mailed to:
