Cafo Annual Report Requirements

.The owner or operator of any concentrated animal feeding operation (CAFO) permitted under the National Pollutant Discharge Elimination System (NPDES) must submit to the Department an annual report by March 1 of each year, according to Title 130, “Livestock Waste Control Regulations,” effective January 1, 2008. (For definition of CAFO, see Title 130, Chapter 1.)
The contents of the annual report must reflect the status and activities of the CAFO during the previous calendar year. The annual report must be accompanied by the annual permit fee, also due by March 1 of each year.
Following is a list and brief explanation of what must be included in the Annual Report. (See Title 130, Chapter 5, for more information.)
Livestock – The maximum number of livestock at the CAFO at any one time during the previous calendar year. All animal species, the number of head of each species and whether that species was in open lots or confined housing must be listed.
Generated Waste – The total amount (estimated) of waste generated by the operation during the previous calendar year, including manure, litter and process wastewater. Amounts should be reported in tons or gallons, as appropriate.
Transferred Waste – The total amount (estimated) of waste sold or given away by the operation in the previous calendar year, including manure, litter and process wastewater. Amounts should be reported in tons or gallons, as appropriate.
Land Application Responsibility --
Name, address and phone number of person who has primary responsibility for land application at the CAFO;
Whether the person is an authorized representative or an employee;
Most recent date the person completed land application training.
Land Application Area –
Total number of land application acres covered by the CAFO’s current Nutrient Management Plan;
Total number of acres controlled by the CAFO and used for land application of livestock waste during the previous year – including manure, litter and process wastewater.
Discharges – A summary of all livestock waste discharges (including manure, litter and process wastewater) from the production areas and the land application areas during the previous year. The summary must include the following information for each discharge:
Date(s) discharge(s) began and ended;
Time of day/night discharge occurred and duration of discharge;
Approximate volume of waste discharged – provide supporting figures.
Nutrient Management Plan Information – A statement of whether or not the operation’s current Nutrient Management Plan on file with the Department was developed and approved by a certified nutrient management planner.
Changes to Nutrient Management Plan – If the CAFO has made any changes to the nutrient management plan during the previous calendar year, the changes must be reported to the Department. Supporting documents must be included with the information submitted. The information submitted should include changes in:
Land application areas and production areas;
Methods of soil sampling or soil analysis; and
Means of determining land application rates.
NOTE: Changes in land application methods that were not included in the permit application and other major modifications require the submission of an application for a major modification to the Department, the appropriate application fee, and Department approval prior to any changes. (See Title 130, Chapter 1 for definition of Major Modification, and Chapter 14, for information required in a Nutrient Management Plan.)
