The Environmental Protection Agency (EPA) promulgated national emission standards for hazardous air pollutants for new and existing organic liquid distribution facilities on February 3, 2004. This rule will require all sources meeting the applicability requirements within this category to meet hazardous air pollutant emission standards reflecting the application of the maximum achievable control technology (MACT).

You may be subject to this subpart if you are a major source of hazardous air pollutants (HAP) and you own or operate new, reconstructed, or existing organic liquids distribution facility. A major source of HAP has the potential to emit 10 tons per year or more of a single HAP or 25 tons per year of combined HAPs. You will not be subject to this rule if the organic liquids distribution facility is used to store, transfer or process organic liquids at an oil and natural gas transmission facility (as defined in Subpart HH) or a natural gas transmission and storage facility (as defined in Subpart HHH).
