| Applicability: |
eCFR Subpart NNN  [ecfr.gov]
This subpart applies to:
- Affected facilities that are part of a process unit that produces any of the chemicals listed in 40 CFR 60.667 as a product, co-product, by-product, or intermediate, and that commence construction, modification, or reconstruction after Dec 30, 1983.
Affected facilities:
- Distillation units not discharging their vent stream into a recovery system;
- Combination of distillation unit and the recovery system into which its vent stream is discharged;
- Combination of two or more distillation units and the common recovery system into which their vent streams are discharged.
Not subject to this subpart:
- Distillation units operating as part of a process unit that produces coal tar or beverage alcohol.
- Distillation units that do not use, contain, or produce VOC.
- Distillation units subject to NSPS DDD.
- Distillation units that are designed and operated as batch operations.
Partial exemptions*:
- Affected facilities with a total resource effectiveness (TRE) index value greater than 8.0;
- Affected facilities in a process unit with a total design capacity for all chemicals produced within that unit of less than one gigagram per year;
- Affected facilities operated with a vent stream flow rate less than 0.008 scm/min.
*These facilities must comply with certain testing, recordkeeping and reporting requirements. Please see the rule text for full details.
